Our Insolvency Team advised two directors of a company about to go into liquidation on their options regarding re-using the name and trading style of that liquidated company going forward in their new business.
It was decided that the directors would seek permission of the Court to be directors of their new company using the same trading style and a similar name to that of their previous liquidated company. We prepared and issued the application to Court and attended a hearing on their behalf, in which the order sought was granted and the directors were given Court permission to re-use the prohibited name.
Our client benefited from our wealth of experience advising directors on their options following liquidation of a company and what they could do in order to be able to reuse the brand that they had built up and been involved with for so long. Our expertise ensured that they did not fall foul of the insolvency legislation, which would have meant criminal and civil sanction for them both if they had not obtained the protection required.
