Our client was an electrical business who had received negligent advice on a VAT issue from its long standing accountants. This advice led to a VAT bill of over £100,000 going back over 5 years. Although the actual claim value was valued at around £70,000, the case raised complex issues involving the cause of the loses and the client’s duty to mitigate its losses.
As the required pre-action protocol letter of claim was met with a denial of liability, legal proceedings were issued. We guided the client through the disclosure and evidence stages and obtained a favourable expert report in relation to the negligence claim.
The case settled two months before the trial for most of the sum claimed and legal costs.
