Our Insolvency Team were instructed to act in a number of non-standard Petitions. One of which occurred following a negligence claim against a company, resulting in a subsequent Winding Up Petition from the Director.
A second non-standard Petition manifested from a Supervisor of an IVA (Individual Voluntary Agreement) with which a debtor had failed to comply and pay their debts.
Our team skilfully handled the cases despite opposition from the debtor challenging the Supervisor’s Petition, as well as challenges raised by one of the shareholders in the Director’s Petition.
The team’s expert level commitment to both Petitions meant that both of our client’s cases were successful: the Director’s company was successfully wound up and the debtor was made bankrupt. Our clients also both received cost orders in their favour.
