Our Insolvency Team had been involved in proceedings brought by a Trustee in Bankruptcy which had been ongoing for several years. Upon the substantive matter finally coming to a conclusion, our client was keen to finalise the position surrounding her remuneration so that the estate could finally be closed.
The Trustee had been unable to obtain any meaningful creditor engagement to the remuneration process and we were therefore instructed to make an application to Court pursuant to Rule 18 of the Insolvency (England & Wales) Rules 2016 for an order to increase the Trustee’s remuneration which had been previously set at £15,000 to £38,000.
Our client benefited from our wealth of experience dealing with remuneration applications in Court and we ensured that she was not out of pocket having worked to achieve a fantastic outcome for the creditors of the bankrupt’s estate over a period of 6 years. The Court ordered that the Trustee’s remuneration be increased to £38,000 as sought, with the legal costs of the application an expense of the bankruptcy estate.
